Newfoundland & Labrador Labour & Employment Standards 2020

Minimum Wage
  • $11.15 per hour (effective 01 April 2018)
Call-in Pay
  • 3 hours at minimum or overtime wage rate
Overtime Pay:
Time + 1/2 times the minimum wage rate
  • Over 40 hours per week

Note 1: Overtime pay is not less than 150% of the provincial minimum wage.
 
Note 2: An employer is not required to pay overtime to employees who work longer than normal working hours at their own written request.

Provincial Payroll Tax
  • Annual gross: Less than $1.3M = 0%
  • Over $1.3M = 2%
Vacation Entitlement
  • After 1 year of employment: 2 weeks
  • After 15 years of employment: 3 weeks

Note: Where employee works at least 90 per cent of normal working hours in a 12 month period.

Vacation Pay
  • 4% of vacationable earnings
  • After 15 years of employment: 6%
Statutory Holidays
  • New Year’s Day (January 1)
  • Good Friday
  • Canada Day (July 1) – also known as Memorial Day
  • Labour Day
  • Remembrance Day (November 11)
  • Christmas Day (December 25)
Statutory Holiday Pay (if worked)
  • 2 times daily wages, or alternate day with pay, or credit annual vacation

Note: Regular wages are determined by multiplying the employee’s hourly rate of pay by the average number of hours worked in a day by the employee in the 3 weeks immediately preceding the holiday.

Notice of Termination
by Employer
  • 3 months – 2 years of employment: 1 week
  • 2 – 5 years of employment: 2 weeks
  • 5 – 10 years of employment: 3 weeks
  • 10 – 15 years of employment: 4 weeks
  • 15 years of employment and over: 6 weeks

Note: When terminating in groups of 50 or more, group termination rules may apply.

Maternity or Pregnancy Leave
  • 17 weeks after 20 weeks of employment. Same if adoption

Note: Most jurisdictions require leaves to be taken within a specified period. Check with the applicable employment/labour standards office.

Parental Leave (available to either parent)
  • 61 weeks after 20 weeks of employment

Bereavement
  • 2 days unpaid / 1 day paid plus 2 days unpaid

Note: For employees employed for less than 30 days: 2 days of unpaid leave in the event of the death of a spouse, child, mother, father, brother or sister, grandparent, grandchild, mother-in-law, father-in-law, brother-in-law, sister-in-law, daughter-in-law or son-in-law. For employees employed at least 30 days: 1 day of paid leave and 2 days of unpaid leave.

Compassionate/ Family Care/ Responsibility
  • 28 weeks / 7 days

Note: Seven days for family responsibility/sick leave; 28 weeks under compassionate care.

  • 7 days
Voting
  • 4 hours
Reservist’s Leave
  • Yes

Note: Leave for Reservists – Employees who are members of the Canadian Forces Reserves and deployed for active service are entitled to a job-protected unpaid leave. Eligibility requirements and period of leave varies-consult applicable employment/labour standards information.

Critical Illness of a Child Leave
  • 37 weeks

Note: If employed at least 30 days.

Death or Disappearance of a Child Leave
  • 104 weeks for death, 52 weeks for disappearance
