Prince Edward Island Labour & Employment Standards 2020

Minimum Wage
  • $12.25 per hour (effective 01 April 2019)
  • $12.85 per hour (effective 01 April 2020)
Call-in Pay
  • 3 hours at regular wage
Overtime Pay:
Time + 1/2
  • Over 48 hours per week

Note: Overtime pay to be 1.5 times the regular hourly wage.

Vacation Entitlement
  • After 1 year: 2 weeks
  • After 8 years: 3 weeks
Vacation Pay
  • 4% of vacationable earnings
  • After 8 years of employment: 6%
Statutory Holidays
  • New Year’s Day (January 1)
  • Islander Day (Third Monday in February)
  • Good Friday
  • Canada Day (July 1)
  • Labour Day
  • Remembrance Day (November 11)
  • Christmas Day (December 25)
Statutory Holiday Pay (if worked)

Notice of Termination
by Employer
  • Less than 6 months of employment: Nil
  • 6 months – 5 years of employment: 2 weeks
  • 5 ≥ 10 years of employment: 4 weeks
  • 10 – 15 years of employment: 6 weeks
  • 15 years of employment and over: 8 weeks
Maternity or Pregnancy Leave
  • 17 weeks after 20 weeks of employment

Note 1: Maximum combined pregnancy/parental leave is 78 weeks. In PEI, an extension of 5 weeks is available if child has condition requiring parental care.

Note 2: Most jurisdictions require leaves to be taken within a specified period. Check with the applicable employment/labour standards office.

Parental Leave (available to either parent)
  • 62 weeks after 20 weeks of employment, adoption 52 weeks weeks after 20 weeks of employment

Bereavement

Note: One day of paid leave and two days of unpaid leave upon death of the employee’s immediate family. Up to three days of unpaid leave for death of extended family member.

  • 28 weeks / 3 days

Note: Three days under Family Leave; 8 weeks under Compassionate Care Leave.

Sick
  • 1 day / 3 days

Note: One day of paid sick leave after 5 continuous years of employment, 3 days unpaid after 3 months of employment.

Voting
  • 1 hour
Reservist’s Leave
  • Yes

Note: Leave for Reservists – Employees who are members of the Canadian Forces Reserves and deployed for active service are entitled to a job-protected unpaid leave. Eligibility requirements and period of leave varies-consult applicable employment/labour standards information.

Critical Illness of a Child Leave
  • 37 weeks within a 52 week period

Note: If employed at least 3 months.

Death or Disappearance of a Child Leave
  • 104 weeks for death, 52 weeks for disappearance
