Northwest Territories Labour & Employment Standards 2020

Minimum Wage
  • $13.46 per hour (effective 01 April 2018)
Call-in Pay
  • 4 hours at regular wage
Overtime Pay:
Time + 1/2
  • Over 8 hours per day or 40 hours per week

Note: Overtime pay to be 1.5 times the regular hourly wage.

Provincial Payroll Tax
  • Payroll Tax 2% of employee earnings
    (paid by the employee)
Vacation Entitlement
  • After 1 year: 2 weeks
  • After 6 years: 3 weeks
Vacation Pay
  • 4% of vacationable earnings
  • After 6 years of employment: 6%
Statutory Holidays
  • New Year’s Day (January 1)
  • Good Friday
  • Victoria Day
  • Canada Day (July 1)
  • First Monday in August
  • Labour Day
  • Thanksgiving Day
  • Remembrance Day (November 11)
  • Christmas Day (December 25)
  • National Aboriginal Day
Statutory Holiday Pay (if worked)
  • Time + 1/2 plus regular pay OR regular pay plus alternate day

Note: If employees’ wages are calculated on a basis other than time, statutory holiday pay must be equal to or greater than the employee’s average daily wages in the four weeks worked immediately before the week in which the holiday falls.

Notice of Termination
by Employer
  • Less than 90 days of employment: Nil
  • 90 days – 3 years of employment: 2 weeks
  • After 3 years of employment: 1 week per year to a maximum of 8 weeks
Maternity or Pregnancy Leave
  • 17 weeks after 12 months of employment

Note 1: Maximum combined pregnancy/parental leave is 52 weeks. The longer period of parental leave applies if maternity/pregnancy leave is not taken.

Note 2: Most jurisdictions require leaves to be taken within a specified period. Check with the applicable employment/labour standards office.

Parental Leave (available to either parent)
  • 61 weeks after 12 months of employment (35 weeks if maternity leave is taken)

Note 1: Maximum combined pregnancy/parental leave is 78 weeks.

Note 2: Most jurisdictions require leaves to be taken within a specified period. Check with the applicable employment/labour standards office.

Bereavement
  • 3 days / 7 days

Note: Length of the leave is 3 days if the funeral/memorial service takes place in community where the employee lives. If the funeral/memorial service is outside the employee’s community, leave is 7 days.

Compassionate/ Family Care/ Responsibility
  • 27 weeks
Sick
  • 5 days
Voting
  • 3 hours
Reservist’s Leave
  • Yes

Note: Leave for Reservists – Employees who are members of the Canadian Forces Reserves and deployed for active service are entitled to a job-protected unpaid leave. Eligibility requirements and period of leave varies-consult applicable employment/labour standards information.
