Alberta Labour & Employment Standards 2020

Minimum Wage
  • $15.00 per hour (effective October 1, 2018)
Call-in Pay
  • 3 hours at minimum wage

Note: Two hours at minimum wage in some circumstances.

Overtime Pay:
Time + 1/2
  • Over 8 hours per day or 44 hours per week

Note: Overtime pay to be 1.5 times the regular hourly wage.

Vacation Entitlement
  • After 1 year of employment: 2 weeks
  • After 5 years of employment: 3 weeks
Vacation Pay
  • 4% of vacationable earnings
  • After 5 years of employment: 6%

Note: For each week of vacation, monthly-paid employees must receive the equivalent of normal monthly wages divided by 4 1/3. Employees in the construction industries receive 6% of their wages as vacation pay.

Statutory Holidays
  • New Year’s Day (January 1)
  • Family Day (Third Monday in February)
  • Good Friday
  • Victoria Day
  • Canada Day (July 1)
  • Labour Day
  • Thanksgiving Day
  • Remembrance Day (November 11)
  • Christmas Day (December 25)
Statutory Holiday Pay (if worked) The general holiday falls on a normal work day:

  • Time + 1/2 plus average daily wages OR alternate day plus regular pay

Note: Average daily wage is determined based on wage averaged over 9 work weeks preceding the holiday.

Statutory Holiday Pay (if not worked)
  • Average daily wages OR a day’s holiday at the average daily wage (if the holiday falls during an employee’s vacation)

Notice of Termination
by Employer
  • Less than 3 months of employment: Nil
  • 3 months – <2 years of employment: 1 week
  • 2 – <4 years of employment: 2 weeks
  • 4 – <6 years of employment: 4 weeks
  • 6 – <8 years of employment: 5 weeks
  • 8 – <10 years of employment: 6 weeks
  • 10 years of employment and over: 8 weeks
Maternity or Pregnancy Leave
  • Up to 16 weeks of unpaid leave after 90 days of employment with the same employer

Note: Most jurisdictions require leaves to be taken within a specified period. Check with the applicable employment/labour standards office.

Parental Leave (available to either parent)
  • Up to 62 weeks of unpaid leave after 90 days of employment with the same employer (combined Maternity/Parental leave not to exceed 62 weeks)
Bereavement
  • 3 days of unpaid bereavement leave per year (unless employment contract states paid leave), per incident of bereavement, after the death of an immediate or extended family member, after 90 days of employment with the same employer
Compassionate/ Family Care/ Responsibility
  • 27 weeks

Note: If employed at least 90 days with the same employer.

Sick
  • 5 personal and family days per year after 90 days of employment with the same employer (Employers aren’t required to pay wages or benefits during leave, unless stated in an employment contract or collective agreement)
Voting
  • 3 hours
Reservist’s Leave
  • Yes

Note: Leave for Reservists – Employees who are members of the Canadian Forces Reserves and deployed for active service are entitled to a job-protected unpaid leave up to 20 days each calendar year. Eligibility requirements and period of leave varies-consult applicable employment/labour standards information.
